1. Two thousand Vietnamese refugees have remained stateless in the Philippines over the last 16 years without being given any status

2. This small number of Vietnamese refugees represents the last group of “Boat People” from Vietnam, stranded in the Philippines since 1989.

3. Australia and the U.K. have provided resettlement for some 300 refugees on compassionate and humanitarian grounds since the year 2000.

4. The U.S. has agreed to accept the majority of the remaining 2,000 Vietnamese refugees for resettlement, and Norway will admit some refugees on similar grounds.

5. Some 200 families (approximately 500 individuals) are expected to be left behind without a durable solution after 16 years of displacement and statelessness.

6. Many of these families have relatives such as parents, siblings, and other relatives living in Canada.

7. The Vietnamese Canadian community is willing and able to find sponsors for all of the 200 refugee families; the City of Ottawa fully supports this initiative.

8. Canada accepts some 30,000 refugees annually and already has in place policies and programs that would allow the resettlement o these families.

9. These families meet the criteria set under the “Country of Asylum” class which requires that the applicant:


a. be outside his/her country of citizenship;
b. has been affected by civil war or armed conflict; or
c. has suffered violations of human rights;
d. has no possibility, within a reasonable period of time, of having a durable solution; and
e. be privately sponsored.

We call upon the Government of Canada to recognize this last group of Vietnamese Boat People as refugees, under the “Country of Asylum” class, and allow resettlement for some 500 individuals on humanitarian and compassionate grounds, during the 2005-2006 Fiscal Year.

1. Deux mille réfugiés vietnamiens sont demeurés apatrides sur le territoire des Philippines au cours des 16 dernières années sans se voir attribuer quelque statut que ce soit.

2. Ce petit nombre de réfugiés vietnamiens représente le dernier groupe de “Boat People" provenant du Vietnam et qu'ils sont coincés aux Philippines depuis 1989.

3. L’Australie et le Royaume-Uni ont permis le reclassement d'environ 300 de ces réfugiés pour des motifs humanitaires et de compassion depuis l’année 2000.

4. Toujours pour les mêmes raisons, les États-Unis ont accepté d'admettre la majorité des 2,000 réfugiés vietnamiens restants sur leur territoire et que la Norvège en admettra quelques autres pour des motifs similaires.

5. On s’attend à ce qu’environ 200 familles (approximativement 500 individus) soient laissées pour compte dans le processus et ce sans aucun recours après plus de 16 années passées à l'étranger sans statut ni patrie.

6. Plusieurs parmi ces 500 individus ont des membres de leur famille (parents, enfants ou autres) qui vivent au Canada.

7. La communauté vietnamienne du Canada est disposée à trouver des commanditaires afin de venir en aide à ces 200 familles de réfugiés et que la ville d’Ottawa approuve pleinement cette initiative.

8. Le Canada accepte annuellement environ 30,000 réfugiés et a déjà en place les politiques et les programmes qui permettraient le reclassement de ces familles.

9. Ces familles rencontrent les critères définissant la catégorie des personnes admissibles au statut de demandeurs d'asile qui exige que le demandeur:

 

a. soit en dehors du pays dont il possède la citoyenneté
b. ait été affecté par une guerre civile ou par un conflit armé; ou
c. ait été victime de violations des droits de la personne;
d. n'ait aucune possibilité, au cours d’une période de temps raisonnable, de régulariser sa situation de manière durable; et
e. soit parrainé par des intérêts privés

Nous demandons au gouvernement du Canada d'accorder le statut de réfugiés à ce dernier groupe de "Boat People" Vietnamiens, sous la catégorie des "demandeurs d'asile”, et de permettre le reclassement des 500 individus concernés pour des raisons humanitaires et de compassion et ce pendant l’exercice budgétaire 2005-2006.

1. Hai ngàn người Việt tị nạn vẫn còn đang ở trong tình trạng vô quốc gia suốt hơn 16 năm qua tại Phi Luật Tân trong tình trạng vô quy chế.

2. Nhóm người Việt tị nạn này là những “Thuyền nhân” Việt Nam cuối cùng, bị kẹt lại tại Phi Luật Tân từ năm1989.

3. Kể từ năm 2000, Úc Đại Lợi và Anh Quốc đã cho phép khoảng 300 người định cư trên căn bản nhân đạo và bác ái.

4. Hoa Kỳ đã đồng ý nhận phần lớn trong số 2000 người Việt tị nạn còn lại này, và Na Uy sẽ nhận một số người tị nạn dựa trên cùng một căn bản.

5. Khoảng 200 gia đình (độ 500 cá nhân) có thể sẽ bị bỏ sót lại mà không có một giải pháp lâu dài nào sau 16 năm tha phương trong tình trạng vô quốc gia.

6. Nhiều gia đình trong số này có thân nhân như cha mẹ, anh em, và bà con đang sống ở Canada.

7. Cộng đồng Người Việt tại Gia Nã Đại sẵn sàng và có thể tìm được người bảo lãnh cho tất cả 200 gia đình tị nạn; thành phố Ottawa hoàn toàn hưởng ứng nỗ lực này.

8. Canada hàng năm nhận khoảng 30,000 người tị nạn và đã có sẵn các chính sách và chương trình giúp những gia đình này định cư.

9. Các gia đình này hội đủ các tiêu chuẩn về “Quốc gia tạm cư” vì các lý do sau đây:

a. họ ở ngoài quốc gia nguyên thủy (country of citizenship);
b. bị ảnh hưởng bởi nội chiến hay xung đột vũ trang; hoặc
c. đã từng là nạn nhân của các vụ vi phạm nhân quyền;
d. không có hy vọng có được một giải pháp dài hạn nào trong một thời gian hợp lý; và
e. được tư nhân bảo lãnh.

 

Chúng tôi yêu cầu Chính Phủ Canada công nhận nhóm thuyền nhân Việt Nam cuối cùng này là người tị nạn, dưới diện “Quốc gia tạm cư ”, và cho khoảng 500 người trong nhóm này được định cư trên căn bản nhân đạo và bác ái trong tài khoá 2005-2006.
